ACKNOWLEDGMENT AND ACCEPTANCE OF THE TERMS OF SERVICE
These Terms and Conditions of Service regulate the relations between Cyber Maintain and you, as a User and/or Client of Cyber Maintain Services.
The owner of this website and the sole person responsible for its management and maintenance is the company BSR AUTOMATED TECHNOLOGICAL SERVICES AND NETWORKS S.A. (“Cyber Maintain”), domiciled in Mexico City.
By accepting these General Conditions either by browsing the Website, checking the acceptance box in a Web Registry or accepting a Purchase Order that refers to these Conditions, you are accepting these Terms and Conditions of Use. The Purchase Order may not contradict as provided in these Conditions except when they expressly provide for this possibility. If you do not agree with these Terms and Conditions, we ask you to refrain from using this website, registering on it or contracting any of the Cyber Maintain Services.
In the event that the Client is a legal entity, the person who accepts these Terms and Conditions guarantees that he is authorized by the Client to accept these Terms and Conditions on his behalf and bind the Client. If you are not authorized or do not agree to these Terms and Conditions, you must not use the Cyber Maintain Services.
MODIFICATION OF THE GENERAL TERMS AND CONDITIONS
Cyber Maintain may, at any time, modify the General Terms and Conditions of the Service. Updated versions of the Terms and Conditions will appear on this website and, without prejudice to the communication that will be made to clients, will be immediately applicable. The Client is responsible for regularly reviewing the General Terms and Conditions. Your continued use of the Service constitutes acceptance of the modifications introduced.
In the event that Cyber Maintain hires the services of a trusted third party to deposit the content of the Terms and Conditions in force at any given time, both parties agree to accept as valid, only the version of said texts that is registered in the systems of the trusted third party and certified by the same.
CYBER MAINTAIN RESPONSIBILITIES
Provision of Contracted Services: Cyber Maintain will give you access to the Services and Content contracted in the applicable Order Forms. We will also provide you with reasonable Customer Support at no additional charge. Cyber Maintain will make reasonable efforts to ensure that the contracted Services will be available 24 hours a day, 365 days a year, with a quality of service comparable to the standards of the online information Industry, except in the case of planned actions previously communicated. to customers and lack of availability resulting from circumstances beyond Cyber Maintain's reasonable control, such as errors by Internet service providers, computer attacks, government orders, etc.
Compliance with the Privacy Policy and Protection of Personal Data: Cyber Maintain will comply with the Personal Data Protection Policy that can be freely consulted on this website. The Client expressly authorizes Cyber Maintain to use the email and telephone numbers indicated in the Purchase Order or in the Registry to communicate any collection incident, such as returned receipts or pending transfers, as well as to communicate any action that Cyber Maintain undertakes to the recovery of late payments.
USE OF THE SERVICE, PRICES AND PAYMENT OF CONTRACTED SERVICES
Use: The use of the service is for information and promotion of the services offered by Cyber Maintain.
Prices: The Customer will pay the prices specified in the Purchase Orders or in the online Purchase Web Form. Except as otherwise indicated in the Purchase Order or in these General Conditions: (i) these prices are based on the contracted Services and Content and not on their effective use or non-use by the Client, (ii) the obligations of payment are not cancelable and payments already made are not returnable, and (iii) the contracted licenses cannot be reduced during the contracted subscription.
Billing and collection: The Client will receive one or more invoices corresponding to the contracted Services and which will be issued by Cyber Maintain. The Client will provide data on one or more payment methods accepted by Cyber Maintain. If Customer provides credit card or bank account information for direct debit, Customer authorizes an Authorized Service Provider to charge such credit card or bank account for all contracted Services indicated in the Purchase Order or Purchase Web Form .
RESERVATION OF INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
All trademarks, copyrights, graphics or logos of Cyber Maintain available on this website are the property of Cyber Maintain and are protected by international law and Industrial Property legislation in Mexico, and may not be copied, transmitted, reproduced or photocopied by any means, in whole or in part, without the prior express written authorization of Cyber Maintain. The trademarks and distinctive signs of third parties are the property of their corresponding owners; Cyber Maintain is not authorized to assign, authorize or license the use of said signs, so the Client must obtain the corresponding authorization from the owner if they wish to use them for any purpose. The Client undertakes not to eliminate the reference to copyright, trademarks and patents, in the document printouts, included in Cyber Maintain products and services.
Cyber Maintain and third-party content providers reserve all rights over the Services and the Content included therein, including all Intellectual and Industrial Property rights. Access to the Service or said contents by the Client in no case implies any type of waiver, transmission or total or partial transfer of said rights, nor does it confer any right of use, license, alteration, exploitation, reproduction, distribution or public communication about said contents other than those expressly stated in these general conditions, without the prior and express authorization, specifically granted, for this purpose, by Cyber Maintain. The Client does not become the owner or acquire any rights over the Cyber Maintain Contents, and expressly recognizes that the Cyber Maintain Service and the Contents of this website are protected by Intellectual and Industrial Property rights.
The Client is informed that the Services may contain hidden identifiers and intentional errors, notarized, in order to demonstrate ownership of the existing rights over the Content and the substantial investment made for its creation and update.
REFUND POLICY
In the event that you are not satisfied with the Service offered, Cyber Maintain will study your particular case and will proceed with a full or partial refund. This policy applies only to purchases made from the website with a credit and/or debit card.
APPLICABLE LAW AND JURISDICTION
These General Professional Terms and Conditions are governed by the legislation of Mexico City, with the exception of the conditions of contracting payment products, which will be regulated by the legal system of the country in which the service provider is domiciled. .
Unless the Purchase Order expressly indicates otherwise, the parties submit for any controversy, expressly waiving any other jurisdiction, to that of the Courts of Mexico City.
